Attorney Russell Matson Comments on Patrick Kennedy Arrest as caller to the "Dennis and Callahan" Radio Show.

Braintree, MA -  May 5, 2006

 

As a caller to the Dennis and Callahan show on Friday, "Russ from Braintree" was asked if he could get Congressman Kennedy "off" from his recent encounter with the DC police, if he were defending him. Attorney Matson answered that he didn't even think that there was enough evidence to charge the Congressman with a crime. And even if he were charged, it would be very difficult to pursue a conviction, given that the ranking police officers did not arrest him, and gave him a ride home. By that action, it would be hard for the police to later claim that he was impaired.

In addition, Attorney Matson did not get a chance to say that he has successfully defended cases involving Ambien use, which Mr. Kennedy has admitting taking. Ambien can have a significant affect on one's reflexes and judgment, and that alone could explain his driving and subsequent behavior, without any alcohol being involved.
